General Terms & Conditions (pursuant to Chapter I, Title 3, Part 3 of d.lgs 206/2005 as amended and supplemented)

  1. Introduction and effectiveness of the General Conditions These general terms and conditions of sale (hereinafter General Terms and Conditions) govern the purchase of products and services, made remotely over the Internet, from the website www.vinifamigliascotta.it (hereinafter Site) in accordance with Italian law as per d.lgs 206/2005 and subsequent amendments and additions (hereinafter Consumer Code). The seller of the products and owner of the Site is: Az. Agr. Scottà Antonio | Via San Pietro 38 | Valdobbiadene (TV) | Tel. 347.5973489 | P.I. 04743960264 E-mail addresses: info@vinifamigliascotta.it The user of the site who intends to purchase (hereinafter the Customer) is obliged, prior to confirming the order, to carefully read these General Terms and Conditions which have been published on the Site and which may be consulted at any time by the Customer also through the link contained in the confirmation email of each order to facilitate memorisation and reproduction. In the event that the user purchasing on the Site requires an invoice to be issued and/or is not a consumer or user as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the regulations on withdrawal described in the relevant section shall not apply, because under the terms of the Consumer Code they apply only to consumers. Agreements made with Az. Agr. Scottà Antonio through the Site are governed by these General Conditions in accordance with Italian law. The reference language for concluding the contract is Italian for sales whose place of delivery is Italy and English for all other places of delivery.
  2. Choosing and Purchasing Products The characteristics and price of the various products for sale on the Website (hereinafter Product or Products) are shown on the page relating to each Product with a specific Product Sheet. The content and a data sheet will be highlighted for each Product. The Customer shall add the Product(s) to the Shopping Cart and, after having read the General Terms and Conditions and the Privacy Policy and confirmed their acceptance with a flag in the appropriate field, shall enter the shipping data, select the desired payment method and confirm the order. The invoice will be sent only upon request by e-mail addressed to info@vinifamigliascotta.it. By sending the order from the Site, which has the value of a contractual agreement, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure, that he/she has read the technical data sheet and understood the characteristics of the Products, and that he/she fully accepts these General Terms and Conditions and those of the payment method selected. The contract stipulated between Az. Agr. Scottà Antonio and the Customer shall be considered concluded with the acceptance of the order by Az. Agr. Scottà Antonio. Such acceptance shall be communicated to the Customer by means of an email confirming the order itself to the email address entered by the user during the order confirmation phase, such email shall contain a reference to these General Conditions, the order number, the shipping details, the list of Products ordered and the total price, including VAT, where due, and the cost of delivery. The Customer will check the confirmation email and, if he/she identifies any errors in the order, he/she will have 24 hours from receipt of that email to contact Az. Agr. Scottà Antonio by phone on +39 347.5973489 or by email by sending an email to info@vinifamigliascotta.it. Once this time period has elapsed, the order will be considered concluded and will be prepared for shipment; no further changes will be accepted, obviously without prejudice to the Customer’s rights pursuant to Article 7 below. Once the order has been received, Az. Agr. Scottà Antonio shall check the availability of the products in its stock in order to process the order. In the event that one or more products are not available, Az. Agr. Scottà Antonio shall promptly notify the Customer via email who, within the next 24 hours, will have the right to reply to confirm the shipment of the products available or possibly to add others, or cancel the order. If no reply is received within that time, the order will be considered confirmed and only the products available will be shipped. In this case, the amount of the missing products will be deducted from the initial total amount of the order.
  3. Information on Products Information and characteristics relating to the Products are available on the Website. All information on the Products is provided in Italian and English. Az. Agr. Scottà Antonio guarantees that Products equal to those indicated and described on the Website shall be delivered, and ensures compliance with all regulations regarding the storage of products until delivery to the place indicated by the user when placing the order. The supplier’s liability applies to all products sold. In the case of packaged products, the supplier is also responsible for the truthfulness and completeness of the information on the packaging.
  4. Prices and Shipping Product prices include all taxes and duties. All prices are expressed in euros. For Az. Agr. Scottà Antonio it is important that purchases are protected from sudden changes in temperature and accidental knocks during shipping. For this reason the products are packed appropriately. To prevent the products from remaining too long in the couriers’ warehouses, shipments are made Monday to Friday
  5. Payment and Invoicing

5.1 Payment methods The Customer may pay the price of the Products and the related delivery charges by credit card and SEPA bank transfer.

Bank transfer The Customer must make the bank transfer within 3 days from the date of the order and send the receipt to info@vinifamigliascotta.it. If this does not occur, the order shall be cancelled and the goods made available again for purchase by other Customers. Customers who have not made the transfer may be contacted by Customer Service in order to clarify whether the cause of the failure to credit the order is due to the Customer’s desire not to confirm the purchase or to other causes. In any case, Az. Agr. Scottà Antonio reserves the right not to dispatch the goods until it has received confirmation of the credit transfer. Data for bank transfer: c/c: Az. Agr. Scottà Antonio IBAN: IT18S0103062150000001257589 Reason for payment: the Customer must indicate in the reason for the transfer the date and order number, which can be found in the confirmation email (e.g. Order 01/07/14 n. 10).

5.2 Order Invoicing If the purchase is made by a VAT-registered entity, it is possible to request an invoice by sending an email to info@vinifamigliascotta.it, in which the VAT number, Tax Code, and the details of the VAT subject with their address must be indicated. In this case, the invoice will be sent via email to the address provided. VAT-registered entities are responsible for the correct input of invoicing details and are explicitly informed that the invoice can be requested within 7 days from the date of the order.

  1. Transport and Delivery The products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate Shipping Information field. All purchases will be delivered by a courier (hereinafter, the Courier) from Monday to Friday, excluding holidays and national holidays. Az. Agr. Scottà Antonio is not responsible for delays that are unforeseeable or not attributable to it. In any case, unless due to force majeure or unforeseeable circumstances, the ordered Products will be delivered within an indicative period of 7 (seven) working days from the day following that on which Az. Agr. Scottà Antonio confirmed the order to the Customer by means of a confirmation email. The aforementioned 7 working day period applies to shipments within Italy. Delivery services active in Italy: the service provides for 1 delivery attempt to the address indicated at the time of the order. If the delivery attempt is unsuccessful, the courier will leave a paper notice of the attempted delivery and ask the Customer to contact the nearest branch to arrange delivery or modify the delivery address. The Courier reserves the right to contact the Customer by phone in case of failed delivery instead of leaving a written notice.
  2. Right of withdrawal As provided for by the Consumer Code D.LGS 206/05 (former right of withdrawal) and Legislative Decree 21/2014, Az. Agr. Scottà Antonio’s customers enjoy the satisfied or refunded guarantee with the possibility of returning purchased products within 14 working days of receipt, except in the case of products which by their nature are excluded pursuant to art. 59 of Legislative Decree 21/2014 and are: c) the supply of made-to-measure or clearly customised goods; d) the supply of goods that are liable to deteriorate or expire rapidly; e) the supply of sealed goods that are unfit to be returned for hygienic or health protection reasons and have been opened after delivery; With reference to these cases of exclusion, the Customer is informed and accepts that among the Products at risk of deteriorating or expiring rapidly are all food products, as the characteristics and qualities of these types of Products are also subject to alteration as a result of improper storage. Therefore, for reasons of hygiene and protection of Customers, the right of withdrawal is applicable only to Products purchased on the Site that can be returned to Az. Agr. Scottà Antonio and put back on the market without danger to the health of consumers (i.e. cosmetic products).

The procedure for exercising the Right of cancellation provides required a communication from the Customer to be sent by registered letter with return receipt, addressed to Az. Agr. Scottà Antonio Via San Pietro 38 31049 Valdobbiadene (TV) The Customer Service of Az. Agr. Scottà Antonio shall, once the communication has been received, open a file for the management of the return and provide the Customer with instructions on how to return the Products, which shall be done by the courier indicated by Az. Agr. Scottà Antonio. The right of withdrawal is governed by the following conditions: In the event of exercising the right of withdrawal, Az. Agr. Scottà Antonio shall reimburse the customer the full amount paid to purchase the goods subsequently returned, including shipping costs where applicable, within 14 days from the date of the notice of withdrawal reception, without prejudice to the right of Az. Agr. Scottà Antonio to suspend payment of the refund until actual receipt of the goods. The refund shall be made using the same method of payment used by the Customer, unless the latter has expressly requested a different method of credit. In case of bank transfer, it shall be the Customer’s responsibility to provide the bank details to obtain the refund (account holder, name and address of the Bank and IBAN). Also in order to be able to guarantee the gratuitousness of the return, the Products must be returned in the same type of packaging in which they were received.

In cases where the right of withdrawal is excluded, Az. Agr. Scottà Antonio will return the purchased products to the Customer, charging the shipping costs to the same. In the event of acceptance of the right of withdrawal, Az. Agr. Scottà Antonio offers Free Returns, keeping the shipping costs for the return of the Products entirely at its own expense. The Customer must wait to be contacted by Az. Agr. Scottà Antonio to arrange for the Products to be returned to the courier.

  1. Warranty and Non-Conformity Defects for Non-Food Products In the event of non-conformity defects of Products sold by Az. Agr. Scottà Antonio, the Customer must immediately contact Az. Agr. Scottà Antonio by phone or by sending an email to info@vinifamigliascotta.it. The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of Products. The Customer is entitled, at his choice and provided that the nature of the Product allows it, to have the conformity of the Product restored, without expenses, by repair or replacement, or to an adequate reduction of the price or to the termination of the contract. The Customer forfeits these rights if he/she does not report the non-conformity defect to Az. Agr. Scottà Antonio within two months from the date on which he/she discovered the defect, unless it concerns a Product that by its nature is perishable or subject to a shorter expiration period, in which case the defect must be reported within that reduced period.
  2. Errors and limitations of liability The information regarding the Products provided through the Website is constantly updated. However, it is not possible to guarantee the complete absence of errors for which Az. Agr. Scottà Antonio cannot be held responsible, except in cases of fraud or gross negligence. Az. Agr. Scottà Antonio reserves the right to correct errors, inaccuracies or omissions, even after an order has been submitted, or to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Terms and the Consumer Code. Except in cases of fraud or gross negligence, the Customer has no right to compensation for damages or recognition of compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance or partial fulfillment of an order.
  3. Complaints Any complaint should be forwarded to Az. Agr. Scottà Antonio by calling +39 071 889403 (Mon-Fri 9:00-17:00, excluding holidays) or by sending a registered letter to the following address: Az. Agr. Scottà Antonio Via San Pietro 38 31049 Valdobbiadene (TV) Az. Agr. Scottà Antonio undertakes to respond to all requests received within a maximum of 7 working days.
  4. The sales contract between the Customer and Az. Agr. Scottà Antonio is deemed to be concluded in Italy and governed by Italian law. For the resolution of any disputes relating to the interpretation, execution or termination of these General Conditions or individual purchase orders, if the Customer is a consumer pursuant to the Consumer Code, the exclusive jurisdiction will be that of the court of their place of residence or domicile if located in Italian territory; in all other cases, the exclusive territorial jurisdiction is that of the Court of Treviso, with any other competent court excluded.

Pursuant to Article 1341 of the Italian Civil Code, the Customer declares to have read and accepted all the articles.
